Attorneys for the billionaire Jeffrey Epstein have sent a stinging rebuke to Roberts’ legal team saying she repeatedly passed up opportunities to make a complaint.
In papers issued to the court on Tuesday, Epstein’s high-powered legal team say she previously told “the FBI not to bother her again”.
They say she repeatedly refused to bring a complaint before the six years of statute of limitations passed.
A ruling will now be made by high ranking Judge Kenneth Marra as to whether to throw out her case.
If granted it would put an end to potential court proceedings in Florida from Roberts.
The move comes as flight records emerged which show Virginia Roberts and the Duke were in the same place on the dates she says they met.
Log details, published by the Daily Mail, from Jeffrey Epstein’s private jet show Virginia Roberts and publicly-held records of Prince Andrew’s engagements show they both in London, New York and the US Virgin Islands when she claims the had sexual encounters.
